Advanced Micro Systems, Inc reserves the right to make changes to this website, these Terms and Conditions at any time, with out notice.



1. Order Policy
Your order to purchase a product on this website constitutes your offer to purchase, which AMS, Inc. may accept or decline in its sole and absolute discretion. Orders are not binding upon AMS, Inc. until accepted by AMS, Inc.. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. AMS, Inc. reserves the right at any time after receipt of your order to accept or decline your order for any reason. AMS, Inc. reserves the right to require additional information based on the requirements of the manufacturer or publisher of the Product. Purchaser shall not disclose any confidential information when ordering from AMS, Inc.. Purchaser will disclose its AMS, Inc. customer number only to its personnel with a need to know. AMS, Inc.ís acceptance of any order from Purchaser is limited to these terms and conditions in their entirety without addition, modification, or exception.



2. Pricing Terms
All prices are subject to change without notice and will be established at time of order acceptance by AMS, Inc.. Order acceptance and sale by AMS, Inc. occurs at time of shipment. Prices for backordered Products are not guaranteed. The purchase price for the products and services you wish to purchase are provided on the form that will appear when you choose to checkout and purchase any product or service. By placing an order to purchase a product or service, you agree to pay the purchase price set forth on the order form.



In the event a product or service is listed at an incorrect price due to a typographical error, an error in pricing information received from our suppliers or our failure to timely update pricing information, AMS, Inc. shall have the right to cancel any order placed for a product or service listed at an incorrect price, whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, AMS, Inc. shall promptly issue a credit to your credit card account in the amount charged to your credit card.



3.1 Payment Terms
Purchaser shall furnish to AMS, Inc. all financial information reasonably requested by AMS, Inc. from time to time for the purpose of establishing or continuing Purchaserís credit limit. Purchaser agrees that AMS, Inc. shall have the right to decline to extend credit to Purchaser and to require that the applicable purchase price be paid prior to shipment. Purchaser shall promptly notify AMS, Inc. of all changes to Purchaserís name, address, or of the sale of substantially all of its assets. AMS, Inc. shall have the right from time to time, without notice, to change or revoke Purchaserís credit limit on the basis of changes in AMS, Inc.ís credit policies or Purchaserís financial condition and/or payment record. Purchaser shall not deduct any amounts owing from any AMS, Inc. invoice without AMS, Inc.ís express written approval, which approval shall be contingent upon Purchaser providing all supporting documentation for such deduction as required by AMS, Inc.. Credit cards (MasterCard, VISA, American Express and Discover Card) will only be accepted at the time of order. No cash payments will be accepted. Our credit and fraud avoidance department or service provider must approve all orders placed by you. In certain circumstances, we may require additional verifications or information before accepting your order. In addition, credit card payments are subject to clearance by the bank or other financial institution that issued your credit card. AMS, Inc. will not be liable if the bank or financial institution refuses to approve or honor your credit card.



3.2 Check payment policy
Advanced Micro Systems,Inc will accept a cashiers check or money order on all BEFORE THE ORDER IS SHIPPED TO THE BUYER. AMS Inc will NOT accept personal checks.



4. Sales Tax; Shipping and Handling Charges and Terms
Purchase prices do not include sales tax. AMS, Inc. may charge sales tax where applicable. If AMS, Inc. does not charge sales tax, you will be responsible for payment of any applicable sales tax in the state, county or municipality in which you reside.
Purchase prices do not include shipping and handling charges. AMS, Inc. offers several shipping alternatives from which you may choose. By placing an order, you agree to pay the shipping and handling charges set forth on the order form. Any delivery or shipment date provided by AMS, Inc. is AMS, Inc.'s good faith estimate, which is based solely upon the estimates of third-party shipping companies. You acknowledge that a product purchased by you may not be available for delivery at the time requested. AMS, INC. WILL NOT BE LIABLE FOR ANY LOSS, DAMAGE, COST OR EXPENSE INCURRED BY YOU AS A RESULT OF ANY DELAY IN THE SHIPMENT, DELIVERY OR PERFORMANCE OF A PRODUCT.



5. Return Policy
All sales are final, AMS, INC is not responsible for any special sales items and no returns on software or consumeable items. Return policy on selected items will be based on manufacturer return policies. IN CASE OF DEFFECTIVE ITEM ONLY, after 10 days of purchase, standard manufacturers' warranty procedure will apply, i.e, defective product would be fixed under warranty and no exchange. For further information e-mail our Returns Department at sales@amsus.com to obtain a Return Merchandise Authorization Number (RMA) before shipping your product. NO returns of any type will be accepted without an RMA number. For faster service, please e-mail the following information for an RMA number. Invoice Number, Customer Name, Customer Phone Number, Serial Number and Nature of the Problem.All products returned MUST be 100 percent in its original condition, contain ALL original boxes and packing materials, have original UPC codes on the manufacturer boxes, contain all manuals, blank warranty cards and other accessories and documentation provided by the manufacturer. Customer is responsible for shipping charges on returned items. Shipping charges are NOT refundable. You acknowledge that you have read and accept our return policies, You are responsible for shipping charges on returned items; will match your shipping method on your replacement or exchange item(s).

AMS, Inc. strongly recommends you fully insure your return shipment in case it is lost or damaged and you use a carrier that can provide you with proof of delivery for your protection. If merchandise arrives damaged: it is best to REFUSE it back to the carrier attempting delivery. If you accept the package make sure it is noted on the carrier's delivery record in order for AMS Inc. file a damage claim. Save the merchandise AND the original box and packing it arrived in, notify AMS, Inc immediately to arrange for a carrier inspection and a pick up of damaged merchandise. If you do not notify AMS, Inc of damaged goods within the first 10 days of arrival, our regular return policy will override any claim of damage, and will fall under all current manufacturer restrictions. AMS, Inc manager to arrange for carrier inspection and a pick up of damaged merchandise and discretion for: credit, replacement, exchange or repair. Manufacturer restrictions do apply and are outlined in our detailed policy. Any item that is missing the UPC can ONLY be replaced with the same item.
NON-DEFECTIVE returns can be accepted directly by AMS, Inc within 10days from the invoice date, AMS, Inc discretion for: credit, exchange , You MUST get RMA number before ship back to AMS, Inc. If we receive a shipment without RMA it will be refused at our dock. All NON-DEFECTIVE returns are subject to a 25 percent restocking fee. Shipping charges are NOT refundable. Defective merchandise can be returned for REPAIR ONLY to the manufacturer direct or any authorized service center in your area .



6. Manufacturer's Warranty
You acknowledge that the products available for purchase from AMS, Inc. are not manufactured, provided or warranted in any way by AMS, Inc.. The products and services sold on this website are subject only to any applicable warranties provided by the manufacturer and service provider, respectively. The manufacturer's and provider's warranties vary on each product and service available for purchase on this website. Prior to purchasing a product or service, you should contact the applicable manufacturer or service provider and obtain a copy of their warranty documentation. Extended warranties may be available directly from select manufacturers and providers. ALL REQUESTS FOR WARRANTY AND TECHNICAL SERVICE AND SUPPORT SHOULD BE MADE DIRECTLY TO THE MANUFACTURER AND SERVICE PROVIDER, AS APPLICABLE, IN ACCORDANCE WITH THEIR TERMS AND CONDITIONS AND WARRANTIES. ALL PRODUCT COMPLAINTS SHOULD BE DIRECTED TO THE MANUFACTURE AND SERVICE PROVIDER. ALL PRODUCT TRAINING, SUPPORT AND SERVICES WILL BE PROVIDED EXCLUSIVELY BY THE MANUFACTURER, UNLESS THE PRODUCT PURCHASED BY YOU INCLUDES SUCH SERVICES WHICH MAY BE PROVIDED BY A THIRD PARTY.



7. Disclaimer and Limitation of Liability as to Products and Services Sold.
AMS, INC. MAKES NO REPRESENTATIONS OR WARRANTIES, EITHER EXPRESS OR IMPLIED, OF ANY KIND WITH RESPECT TO PRODUCTS AND SERVICES SOLD ON THIS WEBSITE. AMS, INC. EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, OF ANY KIND WITH RESPECT TO PRODUCTS AND SERVICES SOLD ON THIS WEBSITE, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. AMS, INC. MAKES NO REPRESENTATIONS OR WARRANTIES, EITHER EXPRESS OR IMPLIED, OF ANY KIND WITH RESPECT TO THE YEAR 2000 COMPATIBILITY OF PRODUCTS OR SERVICES SOLD BY AMS, INC.. These terms and conditions, as published at the time of sale, are the official terms and conditions of sale between AMS, Inc. and Purchaser and may be amended from time to time without notice at AMS 's sole discretion.



9. Miscellaneous Provisions
This Agreement constitutes the entire agreement and understanding between you and AMS, Inc. relating to the subject matter hereof and supersedes all prior negotiations and understandings, both oral and written, regarding such subject matter. You may not assign your rights and obligations under these Terms and Conditions. These Terms and Conditions may not be modified or amended except in a writing signed by you and AMS, Inc.. These Terms and Conditions are governed by the laws of the State of California, without regard to its conflicts of laws principles. If any provision of these Terms and Conditions is or deemed to be unenforceable, illegal or otherwise invalid, that provision and the remaining provisions of these Terms and Conditions will be enforced to the greatest extent permitted by law. Any claim, dispute or controversy (whether in contract, tort, or otherwise, whether preexisting, present or future, and including statutory, common law, intentional tort and equitable claims) against AMS, Inc., its agents, employees, successors, assigns or affiliates arising from or relating to these Terms and Conditions, its interpretation, or the breach, termination or validity thereof, the relationships which result from these Terms and Conditions, AMS, Inc.'s advertising, or any related purchase shall be resolved exclusively and finally by binding arbitration administered by the Judicial Arbitration & Mediation Services, Inc. under its code of procedure then in effect. The arbitration shall be held in L.A County, California. Any award of the arbitrator shall be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction

IMPORTANT: Prices and availability are subject to change without notice. ALL returns must have an RMA number. Shipping, handling and insurance charges are non-refundable. Seller reserves the right to refuse business to anyone.

NO RETURNS WILL BE ACCEPTED WITHOUT A VALID RETURN MERCHANDISE AUTHORIZATION NUMBER (RMA number).

WARRANTY: Seller's memory has a lifetime warranty against defects. Seller reserves the right to repair, replace or refund any defective memory at our discretion. Any memory returned that has been physically damaged will not be refunded or replaced.
